An Occupiers Consent Form is a common requirement of a mortgage lender when there are adults living in a property who are not being named on the mortgage.

A typical scenario is a cohabitee who is not named in the title register / mortgage.

Why do I need independent legal advice?

The occupier ought to receive independent legal advice (ILA) so that they are fully aware of what they are signing. Normally a waiver of rights in the property i.e. they are confirming that they do not have any beneficial interest in the property or any other rights that would prevent a mortgage lender repossessing the property (in the unfortunate event that the mortgage was not paid). The occupier should be made aware that the effect of signing a waiver is that, amongst other things, if the property is repossessed they will have to vacate.

The mortgage lender also wants to ensure that the occupier will rank behind it i.e. that the occupier’s rights are ‘postponed’ and the lender’s rights have priority.

    We will provide you with the advice online, via our iLA personalised meeting room. You will just need a laptop, phone or tablet to join the meeting. From our years of experience, the meetings tend to last for no more than 30 minutes

  • Step 3 - SIGN AND RETURN THE DOCUMENTATION

    During our online meeting, you will sign the relevant documentation.

    We can guarantee that your ILA will be compliant and your documents are correctly witnessed, and we will also help you to return the documents to the correct party in the transaction. Our dedicated team is here to make sure that you do not experience any delays or inconvenience.

    Following our meeting, we will immediately contact the lender to advise that the ILA has been provided and so the whole process can be completed, from start to finish, in less than a day.
